Federal Law Alert
MAY 20, 2025
Federal: EEO-1 Data Collection Now Open!

The EEO-1 data collection online filing system is now open for employers to submit 2024 EEO-1 Component 1 reports. The submission period runs from May 20, 2025, through June 24, 2025—a shorter window than in prior years.

As a reminder, the EEO-1 Component 1 report is a mandatory filing for private employers with 100 or more employees, and (at least for now) federal contractors and subcontractors that meet certain criteria and have 50 or more employees.

The EEOC Instruction Booklet has been updated for the 2024 report and there are two key changes, addressed below.

Elimination of Non-Binary Gender Reporting
Employers will now report employees’ sex only as male or female. Previously, non-binary employees could be noted in a comments section. This option is no longer available.

Removal of Safe Harbor Language
The EEOC has removed references to the “Notice of Failure to File” and associated notifications. It’s not clear what impact this change will have on the enforcement process or whether there will be a shift in how noncompliance is handled.

(Not a Change!) Federal Contractors Still Need to File
Despite the revocation of Executive Order 11246, which mandated EEO-1 reporting for certain federal contractors with 50 or more employees, regulations still require these contractors to file their 2024 EEO-1 reports.

Action Items
If you have reporting obligations, be sure to get your filing done by June 24, 2025.

You can check the EEO-1 Component 1 website: eeocdata.org/eeo1 for additional information.

For specific questions, the EEOC has a Filer Support Message Center available. www.eeocdata.org/EEO1/home/ContactUs
